Terms, Conditions & Refund Policy.

THIS TERMS OF USE AGREEMENT (THE “AGREEMENT”) CONSTITUTES A LEGALLY BINDING AGREEMENT BY AND BETWEEN PIXELCRAFT SRL, A LIMITED LIABILITY COMPANY ORGANIZED UNDER THE LAWS OF ROMANIA, WITH ITS REGISTERED OFFICE IN ALBA IULIA, STR. O. GOGA, NO. 45, CIF: 37953499 (“PIXELCRAFT”) AND THE CLIENT, WHETHER PERSONALLY OR ON BEHALF OF AN ENTITY (“CLIENT”), WITH REGARD TO ACCESS AND USE OF PIXELCRAFT’S WEBSITE: HTTPS://WWW.KINDERGRAFF.RO/ (THE “WEBSITE”) AND ANY OTHER MEDIA FORM, CHANNEL, MOBILE WEBSITE OR MOBILE APPLICATION RELATED, LINKED OR OTHERWISE CONNECTED THERETO. FAILURE TO AGREE AND ADHERE TO ALL OF THE TERMS, CONDITIONS AND OBLIGATIONS CONTAINED HEREIN RESULTS IN THE EXPRESS PROHIBITION OF THE CLIENT’S USE OF THE WEBSITE, AND THE CLIENT IS ORDERED TO DISCONTINUE USE IMMEDIATELY. THEREAFTER THE RELATIONSHIP BETWEEN CLIENT AND PIXELCRAFT SHALL CEASE AND BE OF NO FURTHER FORCE AND EFFECT BETWEEN THE PARTIES, EXCEPT THAT ANY OBLIGATION OF CLIENT TO PAY PIXELCRAFT FOR SERVICES RENDERED SHALL REMAIN AND CONTINUE TO BE AN ONGOING OBLIGATION OWED BY CLIENT TO PIXELCRAFT.

Intellectual Property Rights Unless otherwise indicated, the Website is the property of Pixelcraft and all source code, databases, functionality, software, website designs, audio, video, text, photographs and graphics (“Content”) and the trademarks, service marks, and logos (“Marks”) are owned and controlled by Pixelcraft and are protected by Romanian and European Union intellectual property laws. The Content and Marks are provided “As-Is” for informational and personal use only. No part of the Website or its Content may be used for commercial purposes without Pixelcraft’s express prior written permission.

Ownership of Materials All design and original source files created for the Client (“Projects”) belong to the Client, and the Client shall own the copyright for all Projects. Pixelcraft irrevocably assigns any interest in the Project to the Client. The Client warrants all materials provided to Pixelcraft are owned by the Client and do not infringe third-party rights. Pixelcraft reserves the right to showcase the Client’s work publicly unless otherwise agreed in writing.

Third-Party Fonts If Projects include fonts that require a separate license (“Third-Party Fonts”), Pixelcraft will notify the Client, who is responsible for obtaining the necessary licenses to legally use the fonts. Pixelcraft assumes no liability for Client’s failure to purchase such licenses.

User Representations By using the Website, Client confirms that they: (a) have legal capacity and agree to these Terms of Use; (b) are not a minor under Romanian law; (c) will not access the Website through automated or non-human means; (d) will not use the Website for illegal purposes; and (e) will comply with all applicable Romanian and EU laws.

Prohibited Activities Client agrees not to misuse the Website, including but not limited to: unauthorized use, data scraping, circumventing security, reverse-engineering, uploading harmful content, or harassing staff. All Website activity must comply with Romanian and EU laws.

Client Feedback All feedback or suggestions submitted by the Client (“Submissions”) become the property of Pixelcraft. Pixelcraft may use such Submissions freely, unless otherwise specified under Section 2 regarding ownership of Project materials.

Management and Oversight Pixelcraft reserves the right to monitor the Website, restrict access, and take legal action against misuse or violations of these Terms.

Privacy Policy By using the Website, Client agrees to Pixelcraft’s Privacy Policy, which complies with GDPR. Pixelcraft does not knowingly collect data from individuals under 16 without parental consent. The Website is hosted in the EU.

Returns and Refunds Refunds are granted at Pixelcraft’s discretion. If a refund is granted in the first month of use, all created materials remain the property of Pixelcraft and must not be used. A 25% fee applies to the remaining billable period. Payment gateway fees are non-refundable.

Modification Pixelcraft may change, remove, or update content or features on the Website without notice or liability.

Connection Interruptions Pixelcraft does not guarantee uninterrupted Website access. Client agrees that Pixelcraft is not liable for any inconvenience or loss due to temporary unavailability.

Governing Law These Terms are governed by the laws of Romania and applicable EU legislation.

Litigation Any legal disputes shall be resolved by the competent courts in Alba Iulia, Romania. Jurisdiction and applicable legal proceedings follow Romanian law.

Disclaimer The Website is provided “as-is.” Pixelcraft disclaims all warranties, express or implied, and is not responsible for errors, data loss, unauthorized access, or third-party content.

Limitation of Liability and Indemnification Pixelcraft is not liable for any indirect, incidental, or consequential damages. The Client agrees to indemnify and hold harmless Pixelcraft from any claims arising from Website use, breach of Terms, or violation of third-party rights.

User Data Client is responsible for data transmitted to or from the Website. Pixelcraft is not liable for any data loss.

Electronic Communications, Transactions, and Signatures Client consents to receive communications electronically and agrees that electronic signatures and records satisfy legal requirements for written documentation.

Licensing The Client is solely responsible for licensing any content displayed on their platforms. Pixelcraft’s licenses are not transferrable unless stated in writing.

Showcasing Client Work Pixelcraft may share completed Client work on its digital platforms unless otherwise agreed. Clients may request a Non-Disclosure Agreement to limit public use.

Miscellaneous These Terms and any policies posted on the Website constitute the full agreement between the Client and Pixelcraft. If any clause is deemed invalid, the rest remains enforceable. These Terms do not create a partnership or employment relationship.
